On Wednesday, May 12, 2010, the Executive Committee convened from 6:00 to 9:00 p.m. at the Oregon Electric Station Restaurant at 2711 East Fifth Street in Eugene.

 

Call to Order

On Thursday, May 13, the Commission convened at 8:05 a.m. in Public Session at Northwest Christian University at 828 E 11th Avenue, Eugene in Burke-Griffeth Hall to consider Preliminary Business, Program Approval, and Licensure Issues.  Following lunch, discussions included Professional Practices, Commission Business, and Administrative Rule Proposals and Adoptions.

 

On Friday, May 14, the Commission convened in Public Session at 8:00 am for Commission training regarding Social Media Communication with Nathan Goldberg of Capitol City Data Services.  Immediately following the training, the Commission convened in Executive Session [non-public] to consider Disciplinary Hearings and Investigation Reports.  Following lunch, the Commission reconvened in Public Session for Professional Practice decisions and the Discipline Consent Agenda.  The meeting adjourned at 3:00 pm.

1.0       PRELIMINARY BUSINESS

1.1        Welcome from Northwest Christian University

Jim Howard, Ed.D, Dean, School of Education & Counseling, Michael Fuller, Vice-President of Student Development, and Dr. Dennis Lindsey, Vice-President of Academic Affairs, welcomed the Commission and their guests to the NW Christian campus.

 

1.2        Introduction of New Commissioner, Nancy Watt and Commissioner-elect, Linda Brown.

Nancy Watt introduced herself to the Commission and stated the work of the commission offers mental stimulation and she is delighted to be back.  Nancy replaces Mary Lou Pickard.

 

Linda Brown will replace Francis Charbonnier.  Ms. Brown stated she looks forward to working with the commission to ensure all Oregon children have access to highly qualified, motivating teachers in the classroom.

1.6        Chair Wilson’s Report

Chair Wilson stated the Executive Committee, Professional Practices and the Program Approval Committee met in separate meetings to address agency issues.

 

1.7        Executives Director Chamberlain’s Report

Director Chamberlain reported the Legislature repealed the Religious Dress Stature, ECONorthwest and Chalkboard responded to the Quality Counts report on teacher preparation,  NASDTEC will begin a chapter of Independent Standards Boards, TSPC will hire a new Director of Licensure, and Rob Larson presented the Commission with certificate of recognition for their work with Oregon Leadership Network.

 

1.8        Reports from Liaison Appointees:

Sconce reported the State Board now recognizes online virtual schools as public schools.  Every school district will be required to have one virtual school as an option.  Dr. Gary Phillips, an expert on international benchmarking, gave Oregon standards a “C” after he conducted a comparison with International Standards.

Chamberlain reported:

·         The Legislature is requiring Virtual Charter School teachers to be Highly Qualified (HQ). All administrators, superintendents; assistant superintendents and principals must be licensed.

·         Charter Schools that are not virtual, may still register one half of their teachers and all of their administrators.

·         Passage of HB 3616 convened a task force to develop a system of professional development for pre-service through veteran teachers.

·         The Legislature swept $346, 000 from the TSPC budget.

 

Stern reported the OUS Board has concerns regarding fund balances.  He reported all institutions are facing the challenge of high enrollment demand combined with lower state support in 2011-2013.

2.1        Oregon State University Targeted Site Visit Results

A site visit team consisting of Keith Menk, TSPC, and Margaret Mahoney, University of Oregon, conducted a follow-up targeted visit and confirmed that OSU has complied with the “conditions” established by the commission for unconditional approval at the August 2009 meeting.

RESOLVED FURTHER, that the unit and programs offered by Oregon State University School of Education are unconditionally approved until December 31, 2015.

 

2.2        Willamette University Site Visit Review

            On December 6-9, 2009, a TSPC on-site team reviewed Willamette UniversitySchool of Education program pursuant to Division 10, to evaluate compliance with Teacher Standards and Practices Commission’s established standards for program quality in Division 17.

RESOLVED FURTHER, that the unit and programs offered by Willamette University – School of Education are approved until December 31, 2016.

 

RESOLVED FURTHER, if the NCATE continuing visit is earlier than 2016, the state may decide to conduct its visit at the same time if Willamette is so inclined.

 

            2.3        Willamette University - Major Modifications

Dean Moore explained that Willamette renovated the Reading and ESOL programs to make them more robust to ensure candidates will be better prepared for 21st century teaching.

RESOLVED that, after review by the Program Review Committee on April 23, 2010, the modifications to the WU Reading and ESOL endorsement programs constitute a major modification.

 

RESOLVED FURTHER that, the proposed modifications and the Program Approval Committee’s recommendation regarding adoption of the modifications will be presented to the full Commission at the August 2010 Commission meeting.

 

2.4        Western Oregon University – Major Modification

The faculty of the Division of Teacher Education at Western Oregon University (WOU) proposed several changes to the Master of Arts in Teaching (MAT) initial licensure program.  Faced with the necessity of making program changes to rectify an issue with credit overloads for summer term, faculty used this situation as an opportunity to address some identified areas for programmatic improvement and update the program in relation to research on teacher preparation and trends within the field of teacher education.  The total credits of the program have been reduced from 57 to 53 credits overall.

2.5        Portland State University Site Visit Report

On April 23, 2010, the Program Approval Committee met and considered the site visit review team and the Executive Director’s recommendations to the Commission regarding that site visit.  After hearing from the program, considering the evidence and due deliberation, the Program Approval Committee does not agree with the site visit team, nor with the Executive Director with regard to OAR 584-017-0185 Evidence of Effectiveness.

 

Motion to adopt the resolution with the rule correction in resolution #1 from 584-017-0060 to

584-017-0070 School Based Personnel for the Program.

RESOLVED, that the Commission finds that the following standard is “unmet” following the site visit and analysis of the rejoinder:  OAR 584-017-00[60] 70 School-Based Unit Personnel for the Program.

 

RESOLVED FURTHER, that the Commission does not accept the Executive Director’s recommendation and further finds that the evidence does not support the site visit team’s finding that OAR 584-017-0185 Evidence of Effectiveness was unmet following the site visit.

 

RESOLVED FURTHER, that the Commission approve the unit and licensure programs offered by Portland State University Graduate School of Education for one year with the following condition:

 

a. By February 2011 or sooner, the unit submits the redesigned reading program to the Commission and demonstrates that assurances are in place with regard to the placement of reading candidates; and

 

RESOLVED FURTHER, that the Commission will issue an unconditional approval of PSU’s unit and licensure programs until December 31, 2015, following the program’s fulfillment of all of the conditions.

 

2.6        Social Worker Program Standards

Following meetings with stakeholders, commission staff is bringing the proposed draft for program review standards to the commission.  The proposed standards will be referred to hearing for adoption as new administrative rules in Division 17 (Standards for Program Approval).  New legislation was passed in 2009 increasing the scope of the licensed clinical social worker.  Accordingly, the State Board of Licensed Social Workers has raised concerns with regard to new licensees practicing clinical social work in violation of the new proposed license.

2.7        Salem-Keizer School District’s Continuing School Counselor Proposal

Currently, there are no university programs offering a Continuing School Counselor program for licensure.  This proves to be an obstacle for completing the necessary requirements for a Continuing School Counselor License for those wishing to obtain the license.

 

Salem-Keizer Public Schools, Guidance and Counseling Department, is submitting this program proposal to TSPC for review and approval.  This program would provide the required supervision and subsequent validation for advanced counseling competencies.

RESOLVED that, the Salem-Keizer proposed program for Continuing School Counselor Licensure will submit preconditions to the Commission at the August 2010 meeting pursuant to OAR 584-010-0015.

 

RESOLVED FURTHER, that following submission and approval of the pre-conditions, the Commission will consider the district’s proposal to offer a Continuing School Counselor licensure program.

 

2.8        Division 17 Standards Update

A workgroup with representatives of the Commission and OACTE have reviewed our current standards and compared them to the National Council for Accreditation of Teacher Education (NCATE) unit standards.  The workgroup identified critical policy issues along with recommendations for wording in the state standards. 

 

Other issues discussed: the rubrics for the national standards, the revised rubrics for the diversity standard, the recommended new standards for cultural competency, and the crosswalk of current Division 17 standards to the national standards. Concern was expressed regarding inserting standards in policy rubrics rather than explicitly within an administrative rule.

 

2.9        Program Review Update

The proposed new Web-based program review process was piloted at the Warner Pacific College site visit in February and the Concordia University site visit in April.  Both institutions provided exhibits and data to support the visit.

 

As a result of the two visits, the programs made the following observations:

·        The web-based systems must allow the institution to determine the organization of exhibits as it relates to their evidence of fulfilling the standards.

·        The system needs to be available early in the process to allow the institution to begin entering data and exhibits months prior to the site visit.

·        Institutions need technical support and training in use of web-based system.

 

            2.10      Report on Special Education (SPED) Program approval Template

Substantial revisions to the special education teaching license endorsement standards were permanently adopted by the Commission at the November 2009 meeting in OAR 584-065-0035. Currently approved programs must show that their programs align with the newly revised standards.

2.11      Title II Report

Title II includes accountability measures in the form of reporting requirements for institutions and state teacher preparation and licensing. Under the 2008 newly re-authorized Higher Education Opportunity Act, the Title II reporting format and requirements change significantly over the next two reporting years.

 

The Title II reports include data on pass rates by institution and statewide, passing scores for assessments used by the state and information on licensure types. Lastly, all programs submitted their reports electronically.  Several issues surfaced around the uploading of data to the Westat reporting website.  Westat indicates that this was a pilot year for the new data requirements and a test year for the new web-based reporting system for institutions.  Institutional reports were due to the state on April 30, 2010, and the state report is due to the USDOE on October 2010.

 

      2.12      Site Visit Schedule

Program Approval Site Visit Dates were listed for Fall 2010 – Spring 2017 Academic Years.

 

 

3.0       FULL COMMISSION CONSIDERATION OF LICENSURE ISSUES

3.1        Candidates Reviewed for Alternative Assessment

The Commission allows alternative assessment of teacher and teacher candidates in lieu of subject matter tests which includes:  1)  documentation of at least two attempts at the subject matter exams with at least one attempt within the last calendar year; 2)  a transcript review to determine whether the candidate’s coursework is aligned with the endorsement for which the candidate is seeking waiver using Division 38; 3)  verification of a 3.0 or better GPA in the content area; 4)  evidence that part of the coursework in the content area has been completed within the three years prior to application for alternative assessment; and 5)  two letters of recommendation attesting directly to the educator’s demonstrated competency in the content area.

 

TSPC staff completes alternative evaluation summaries of the candidates and submits the evaluations to the Commission for ratification.  Attached is documentation for ELEVEN (11) candidates for Alternative Assessment.

3.2        Licensure Director’s Report

Director McCann reported that licensure staff set benchmarks to help improve response time to licenses.

McCann and licensure staff attended the Professional Educator Fair in Portland and traveled to Albany SD to meet with teachers regarding their licensure questions. McCann also met with Zenaida M. Lyles, Education Director for the Confederated Tribes of the Umatilla Indian Reservation (CTUIR).  Lyles shared information about the Cayuse endorsement and explained the difference between Cayuse, Nez Perce; and Cayuse/Nez Perce languages.  The endorsement has been updated the TSPC licensure system and the licensure handbook on the web. 

 

3.3        Continuing Administrator Renewal Proposed Amendments

In a memo dated May 13, 2010, the Oregon Professors of Educational Administration (ORPEA), requested that the Commission amend the rules to: “change the 9-year two renewal period for the IAL” to a 6-year one renewal period to better prepare our Oregon administers to meet both building and system level needs for closing achievement gaps and keeping our schools abreast of current educational demands.

3.4        Conditional Assignment Permit - Change in Significance

Removed from the agenda.

 

3.5        Out of State Teacher Testing

The Commission agreed to consider a proposed rule to allow out-of-state teachers who have passed licensure tests in other states to waive the comparable Oregon subject-matter test.

 

In summary, the Commission agreed to the following concepts:

·         Waive licensure tests if comparable test passed from another state;

·         Allow for academic evaluation for educators who have taught five years of half-time or more on a non-provisional license appropriate for the assignment who have not passed a licensure test; and

·         Allow out-of-state teachers with full non-provisional licensure to waive the Basic Skills test with a master’s degree.

3.6        Calculating Licensure Expiration Dates for Deployed Educators

There are several educators who have been deployed while in active duty during the past few years.  Many of them have held new licensure (Initial I Teaching Licenses) and are returning to either expired licenses or nearly expired licenses. If the license was issued after July 1, 2005, then they are also required to “show progress” toward completion of their Continuing or Initial II requirements.

 

The Executive Director crafted the following policy for how to calculate the amount of time to “add on to” an expired or nearly expired license upon proof of time on active duty.  The formula is as follows:  The time served on active duty plus the time remaining on the license when they were deployed, beginning upon the end of the active duty period.

 

3.7        Career and Technical Education Teaching Licenses Update (CTE)

Several new administrative rules regarding proposed changes to the CTE licenses were submitted to the Commission in February and referred to hearing for adoption in April.  These rules are up for adoption at this meeting.

 

To ensure there is less confusion regarding the role of the Instructor Appraisal Committee and their role in recommending candidates for licensure, OAR 584-042-0022 - Instructor Appraisal Committee was proposed for the Commission’s consideration.

3.8        Scope of Administrator Licenses Report

The question before the Commission was what administrative work requires administrative licensure?  A common understanding for many districts centers on the evaluation aspect of administrators.  If you supervise and evaluate teachers, you need an administrative license. 

 

The Licensure Committee requested a separate stakeholder meeting to further discuss Continuing Professional Development (CPD) and Administrator licensure with stakeholders.

 

3.9        Continuing Professional Development Report

At the February Commission meeting, the Commission discussed CPD and administrative rules and standards.  Additionally, the Commission looked at proposed amendments to Division 90.

 

The Commission felt that CPD should be the responsibility of the individual, not the district.  If we accept this recommendation, how will staff proceed to implement and roll out this change in CPD accounting and tracking? 

 

The Licensure Committee agreed to meet in June to conduct further discussions with stakeholders to explore the next steps in oversight of CPD.

 

3.10      School Counselor Licensure Practicum

Unlike other licenses, the requirements for the Initial I School Counselor License include an explicit reference to a practicum experience. All other licenses include the practicum requirement within the preparation standards and not explicitly, separately in the eligibility for licensure requirements.  The “teaching” practicum experience is included in both the state and national preparation standards.  This practicum is in addition to the school counseling practicum. 

 

The Executive Director recommended the following:

·         Retain the current standards for school counseling preparation, including the Track II experience in a teaching practicum for persons new to the profession.

·         Remove the teaching practicum requirement from the rule eligibility requirements.

 

After a lengthy discussion, the commission requested staff gather information regarding how other states handle the practicum issue and bring it back to the August meeting.

 

3.11      Executive Director Approved Waiver (OAR 584-052-0027)

OAR 584-052-0027 requires that the Executive Director report when she makes a waiver pursuant to OAR 584-052-0027(1). The Director approved the waiver for two educators pursuant to OAR 584-052-0027, believing the intent of the Commission had been met with regard to additional graduate work.

 

3.12      Restricted Substitute License Report

At the February Commission meeting, the Executive Director, requested review of the Restricted Substitute License.  Following discussion of the issues, the Commission requested a report regarding the number of Restricted Substitute Licenses issued to districts.

 

The appearance is that this license allows individuals with no education preparation to work as substitute teachers.  Staff believes that the use of this license has not been monitored and is vastly overused by many districts.  There are currently 731 active Restricted Substitute Licenses.


 

The discussion involved staff’s concern regarding the over-use of this license. Staff suggested allowing a one-time Restricted Substitute License for three years with no renewals or extensions. 

 

3.13      Review of Licensure Rules to Adopt

A hearing was held on April 22, 2010, at 1:00 p.m. at the TSPC offices.  Some testimony was received regarding the rules.  Prior to the rule hearing, TSPC staff met with ODE staff regarding proposed minor amendments to the new proposed CTE rules. As a result of that meeting, it was proposed that the Commission not adopt the new proposed OAR 584-042-0041Assignment in a CTE Program.  While it is well-intentioned, it would actually apply to a very few instances and only in programs sufficiently large to have several CTE licensed teachers in the district.  [See 6.4 and 6.4a]

 

Chamberlain stated Legislative Counsel (LC) questioned why TSPC is allowing licensees to wait until the first renewal to pass the Civil Rights test. LC interprets the statute to say applicants must take the Civil Rights test before they are granted a license.  Chamberlain stated she would discuss this test requirement with LC.

      4.2        Report on Charter School Registry

The Professional Practices unit completed a statewide audit of charter school registered or licensed educators. The charter schools audit checked whether at least fifty percent of the teachers hold a TSPC license. Less than four percent of charter school teachers are out of compliance with statutory requirements. 

 

Eighty percent of reported administrators were properly licensed or registered.  Of the twenty percent found out of compliance, eighteen percent hold a valid teaching license and were eligible for an administrative registration. The ratio of licensed vs. registered at the administrative levels resulted in approximately seventy percent licensed and thirty percent registered.

 

      4.3        Review of Professional Practices Rule to Adopt from April 2010 Hearing

A hearing was held on April 22, 2010, at 1:00 p.m. at the TSPC offices.  No testimony was received in opposition to the proposed amendments to OAR 584-020-0040 Grounds for Disciplinary Action.

      5.1       Oregon Leadership Network Presentation on Restructuring

The Oregon Leadership Network was formed under a Wallace grant as the State Action for Educational Leadership Program (SAELP).  The focus of the work this past ten years has been Instructional Leadership for Equity.  TSPC has been a partner in the OLN from the beginning. 

 


 

The Wallace funding for state leadership work ended this year.  The OLN has been working hard to develop a funding model that will sustain the work, the network, the ongoing district participation and the professional development devoted to instructional leadership for equity.

 

The Executive Director is seeking the approval of $1,250 annually to support the continuation of the work.

      5.2        NES Test Adoption Update

The new NES tests are online for full implementation on September 1, 2010. Features of the new tests include: Practice Tests, Electronic Score Reports, Pearson VUE Test Centers, Results Analyzer for higher education, and Immediate Test Results with the exception of fields with performance components (e.g., Spanish).

 

The Commission agreed to meet on August 19, 2010 to set the cut-scores for the new tests.

 

5.3       NCATE Seven-year Cycle Proposal

On February 3, 2010, TSPC received the information below related to NCATE follow-up visits after initial accreditation or probation removal visits.

 

Dear NCATE State Contact,

At its October 20 – 23, 2009 meeting, the NCATE Unit Accreditation Board adopted a resolution to change the visit cycle for first continuing accreditation visits and for visits following a probation visit from five to seven years.  An exception was made for partnership states that require the five year cycle.  The motion stated:

 

“The P&E Committee moves the adoption of a seven year cycle for institutions that have been accredited for the first time or hosted a visit to successfully remove probation. Further, the committee moves that the five year visit cycle be retained for newly accredited institutions and those that successfully remove the probation status that are located in states that require a five year cycle. The NCATE staff is encouraged to continue to discuss the possible expansion of the visit cycle with those partnership states that continue to require the five year cycle.” 

 

This email is to ascertain if your state will approve this change in the visit cycle or whether your agency wants to retain the five year visit cycle for first continuing accreditation visits and those following a probation visit.

The Commission convened a workgroup to develop an employer and candidate survey to assist programs in obtaining necessary data for continuous improvement.  The survey was introduced to the Commission at the February meeting. 

 

Following the February meeting, Commission staff sought expertise in validating the survey.  The cost of validating the survey is low enough to allow the Commission to obtain the validation without going through protracted procurement procedures (less than $5,000); however, it is sufficiently high that staff is seeking direct Commission approval for the expenditure.

The agency budget development cycle has begun.  The budget process proceeds in distinct steps:

1.       Agency Request Budget (ARB): is the first phase of the budget development process;

2.       Governor’s Recommended Budget (GRB) is the second phase of the budget process;

3.       Legislatively Approved Budget (LAB) is the third phase of the budget process;

4.       Policy Package Proposals:  A policy package is how the agency proposes changes to the budget that was adopted last biennium.  These would include requests for new staffing; requests for additional capitol expenditures and requests for fee increases.

Most people have jumped on the social media bandwagon and used different aspects of social media networks in our daily lives.  Blogs, Twitter, Facebook, MySpace, etc. are just a few of the social media vehicles. The Professional Practices staff asked Mr. Goldberg to provide a training session on these issues.

 

Nathan Goldberg, Owner of Capitol City Data Services, explained the different types of social media available as well as electronic data recovery and computer forensic investigations.  This information will contribute to the commissioners knowledge base with regard to future misconduct reports related to electronic social media.

The Commission held an executive (non-public) session per ORS 192.660(2)(h) and (f) on the following matters:  1) receiving and discussing preliminary investigation reports on complaints and charges against licensed educators; 2) taking action to dismiss the complaint or to charge the educator; 3) deliberating the hearing record in disciplinary proceedings; 4) consulting with counsel regarding litigation likely to be filed under ORS 192.660(2)(h) and regarding privileged consultation regarding other legal matters under ORS 192.660(2)(f); and 5) 60-day resignation notice hearing pursuant to ORS 342.553.  Adoption of an order resulting from a hearing must be done in public session.  See ORS 192.660(2)(b) and ORS 342.175 to 342.190.

 

8.1        Proposed Orders/Actions

Eleven stipulated orders, seven default orders and three final orders were considered in non-public session and referred to public session for adoption.  One stipulated order was returned for further negotiation.

 

8.2        Letters of Informal Reproval

The 2009 legislative session passed SB 119 that authorizes TSPC to issue a letter of informal reproval under certain circumstances.  The Commission considered four letters of reproval in non-public session.  Three letters were adopted and one was returned for additional negotiation.

 

8.3        Preliminary Investigation Reports Recommending Action to Dismiss

Following discussion and deliberation on 42 preliminary investigation reports in non-public session, the Commission directed the Executive Director to dismiss all of these complaints received from patrons and internal referrals.

 

8.4        Reports Requiring No Further Action Under OAR 584-020-0041(2)

Following discussion and deliberation on 12 preliminary investigation reports in non-public session, the Commission directed the Executive Director to take no further action on these reports received from districts.

 

8.5        Preliminary Investigation Reports and Action to Charge

The Commission considered 24 preliminary investigation reports in non-public session and directed the Executive Director to charge all with violation of the Standards.

The Commission considered one discipline case and advised the Executive Director to proceed with charging the educator with misconduct.

 

8.9        Consideration of Cases from April 8, 2010, Professional Practices Committee meeting

On April 8, 2010, the Professional Practices Committee met to deliberate Proposed Orders issued by the Office of Administrative Hearings on several contested case hearings.  The Commission may modify the proposed orders issued by an administrative law judge.

 

8.10      Report of Cases Pending an Investigation Before the Commission

The Professional Practices Chair reported in non-public session that there are 224 cases pending an investigation.  Of those, seven are pending disposition in another venue.

 

8.11      Report of Cases Charged or Pending a Hearing

The Professional Practices Chair reported in non-public session that there are 99 cases pending the hearing process.  Of those, 50 are either awaiting a response from the educator in which to request a hearing or the notice of opportunity for hearing is being drafted.

 

8.12      New Cases Received Since Last Meeting

The Professional Practices Chair reported in non-public session that the Commission received new complaints or internal referrals on 37 educators.  District Superintendents, under OAR 584-020-0041, submitted 38 reports of alleged misconduct by educators.

b) Mr. Gordon shall comply with all Standards for Competent and Ethical Performance of Educators under OAR 584 Division 020.

Violation of any of the terms of probation may constitute an independent basis for the Commission to impose discipline, up to and including revocation of Mr. Gordon’s Oregon Teaching License, subject to his right to a hearing on the issue of whether he violated probation.  In light of Mr. Gordon’s previous instances of misconduct, any future violations will be viewed by the Commission to be very serious.

RESOLVED FURTHER, that the Commission shall inform the Portland Public School District of this action.

 

The adopted order states: The Commission adopts and incorporates herein the above findings of fact and conclusions of law, and based thereon, Suspends the Charter School Registry of Adam Gregg Reid for a period of three (3)months from the effective date of this order.

The adopted order states: The Commission adopts and incorporates herein the above findings of fact, conclusions of law, and based thereon, suspends the right to apply for a license for three months to Ana I. Muñoz from the date of this order.

The Executive Director recommends adoption by single consent motion the following listed items which are identified on the agenda by a “^”: 9.1, 9.2, 9.3, 9.4, 9.7, 9.8, 9.9, and 9.10.  Any of these items may be removed from the Consent Agenda upon the request of any commissioner.  Items removed from the Consent Agenda will be considered in the order they are listed on the agenda.
