License for Conditional Assignment (LCA)
(1) Upon
filing a correct and complete joint application and fees in form and manner
prescribed by the commission, an educator may be granted a License for
Conditional Assignment (LCA).
(2) The
LCA will be issued for one to three years in one year intervals based upon the
requirements or program needed for the endorsement area in which the educator
wishes to teach (See, subsection (5) below).
(3) To be
eligible for the LCA the educator must hold an active Basic, Standard, Initial
or Continuing Teaching License and must never have held any one of the
following licenses endorsed in the area in which the educator is seeking to
teach out of field:
(a)
Conditional assignment permit;
(b)
Restricted Transitional;
(c)
Emergency;
(d)
Transitional; or
(e)
Initial.
(4) The LCA
is required when teaching out-of-field under any of the following
circumstances:
(a)
Assignment at any grade level not held on the underlying license;
EXAMPLE: A
high school authorized teacher teaching in grade 4 would require a LCA for any
amount of time teaching outside of her grade level.
(b)
Teaching assignments for more than 10 hours weekly in one subject-matter area
without the appropriate subject-matter endorsement;
EXAMPLE :
A physical education teacher without a health endorsement teaching health three
periods of the day would require a LCA for health. If only teaching two periods
a day; that would fall under the 10 hours per week threshold.
(c)
Teaching in more than one unendorsed subject-matter endorsement area; or
EXAMPLE :
If the physical education teacher above was teaching one period of health and
one period of math; then a LCA would be required for both areas regardless of
the 10 hours per week rule. The 10 hours per week rule applies to one subject
only.
(d) Moving
from one licensure area to another such as from teaching to school counseling
or administration;
(5)
Duration of the LCA: The term of the LCA will be subject to the following
conditions:
(a) A LCA
may be issued for one year only for licensure endorsement areas requiring only
a test and experience or coursework of nine (9) quarter or six (6) semester
hours or less to add the endorsement to
the teaching license;
(b) A LCA
may be issued for up to three years only for endorsements requiring an academic
program beyond nine (9) quarter or six (6) semester hours.
(c) The LCA
is not renewable and is not eligible for a 120 day extension beyond its final expiration
date.
(d) The
LCA will not be issued for a duration that exceeds the expiration date of the
underlying license that make the applicant eligible for the LCA. In these
cases, the LCA may be re-activated for a time as determined by the Executive
Director. In all cases, the amount of
time received will not exceed a total of one year if issued pursuant to
subsection (5)(a) above or a total of three years if issued pursuant to
subsection (5)(b), above.
(6) A LCA
will not be issued under the following circumstances. If the applicant :
(a) Holds
any of the following licenses:
(A)
Restricted Transitional Teaching License
(B)
Limited Teaching License;
(C)
American Indian Language;
(D)
Teaching Associate License;
(E) Any Career
and Technical Education Teaching License;
(F)
Substitute Teaching License;
(G)
Restricted Substitute Teaching License; or
(H)
Exceptional Administrator License.
(b) Has
never held an Oregon non-provisional teaching license;
(c) Is an LCA
for administration but does not hold a master’s degree; or
(d) Is
seeking conditional assignment in school counseling, school social work or
school psychology but does not hold at least a bachelor’s degree or master’s
degree in the respective field of counseling, social work or psychology;
(7) The LCA
is restricted to use within the district, charter school or private school that
has jointly applied with the applicant. However, a new district, charter school
or private school may request to be named as co-applicant district so long as
there is time remaining since the date the LCA was first issued, and
application for a duplicate indicating the new assignment is filed and issued.
(8) An LCA
cannot be renewed or later re-issued for the same authorization level or
endorsement area previously approved as a conditional assignment permit.
(9) After
the LCA has expired, the educator must have completed all requirements
necessary to add the appropriate endorsement, grade-level authorization or new
licensure program in order to continue working in the area in which the
educator is not properly licensed. Continuing to work as an educator on an
expired license is a violation of licensure law and is unauthorized. The
license-holder or the assigning administrator or both may be subject to
sanctions by the commission pursuant to OAR 584-020-0040.
(10)
Extensions to the LCA will not be allowed or granted.
(11)
Effective upon filing the Commission will no longer issue Conditional
Assignment Permits (CAPs). All current
CAPs will be converted to LCA’s for the remaining duration on the CAP without
formal application by the educator.
