RECOMMENDATION: |
The
Executive Director recommends adoption of the following resolution(s): RESOLVED,
that following rules are referred to hearing for amendment and repeal. RESOLVED
FURTHER, that the following rule actions are filed immediately as temporary
rules. RESOLVED
FURTHER, that all holders of the NCLB
Alternative Route Teaching Licenses and their districts are notified that
the Commission is required to repeal the license and that effective
immediately, holders of this license no longer meet the federal definition of
“highly qualified.” RESOLVED
FURTHER, that all current holders of the NCLB
Alternative Route Teaching License will have their license converted to
the equivalent Restricted Transitional Teaching License. |

INFORMATION: |
On September 27, 2010, the
Ninth Circuit invalidated a federal regulation (the federal version of an
Oregon administrative rule) that required states to allow persons making
satisfactory progress toward completion of a full certification program
through an alternative route to be “highly qualified” under federal law. |

As a
result of the regulation, Oregon was required to show that we allowed
alternative route candidates who might otherwise meet the definition of “highly
qualified” to be recognized as highly qualified.
