Definition of “newly hired” teacher:

 

1.                  Teacher hired after the first day of the 2002-2003 school year.

2.                  All teachers hired after the first day of the 2002-2003 school year in programs supported by Title I funds must be highly qualified.

 

All teachers of core academic subjects must be highly qualified in that subject by the end of the 2005-2006 school year.

Alternative Routes (For NCLB) only:

2.                  No teacher may be considered to be on an Alternative Route until after September 1, 2003.

3.                  Approved teaching license will be called:

a.                   Approved NCLB Alternative Route Teaching License

4.                  All teachers on an alternative route must also:

a.                   Have a Bachelor’s degree; AND

b.                  Demonstrate core academic subject matter competency by:

i.                     Holding a major in the core academic subject in which they are teaching; or

ii.                   Passing the TSPC approved subject-matter test for that subject; or

iii.                  For Elementary only, passing, Multiple Subject Assessment Test.

5.                  The District must request an Alternative Route License with the candidate and must certify the following

a.                   Before beginning teaching and while teaching the teacher is receiving high-quality professional development that is sustained, intensive and classroom-focused in order to have a positive and lasting impact on classroom instruction; and

b.                  The teacher will participate in a program of intensive supervision that consists of structured guidance and regular ongoing support for teachers OR a teacher mentoring program; and

c.                   The teacher will demonstrate satisfactory progress toward full certification as prescribed by TSPC.

6.                  Teachers on approved NCLB Alternative Route Teaching License are only highly qualified for 3 years[5] then must meet all requirements for full state certification.[6]

Definition of Bachelor’s Degree:

1.                  Must be from a regionally accredited institution in the United States; or

2.                  Must be from a foreign institution that is appropriately accredited as affirmed through the Oregon Office of Degree Authorization; or

3.                  A higher degree in the arts or sciences or an advanced degree in the professions from a regionally-accredited institution may validate a non-regionally accredited bachelor’s degree.[7]

 

Definition of “rigorous state test”:

1.                  The Multiple Subjects Assessment for Teachers Test (MSAT) for elementary; or

2.                  NTE Core Battery Test of Communication Skills and General Knowledge; or

3.                  The appropriate PRAXIS or NTE subject-matter test for middle-level and high school.

 

 

Definition of “not new” to the profession:

1.                  A teacher is “not new” to the profession if the teacher has been teaching on an approved license in any state, in a public or regionally accredited private school a total of three or more complete school years.

2.                  Subject-matter assignment restrictions for BASIC and STANDARD Elementary Endorsements in art, educational media, foreign language, health, home economics, technology education, mathematics, music, physical education and reading remain in effect. (See OAR 584-036-0015.)

 

Definition of “new” to the profession:

1.                  A teacher is “new” to the profession if the teacher has been teaching on an approved license in any state, in a public or regionally accredited private school less than three complete school years.

 

 

Definition of “complete school year”:

1.         Has taught the at least one-half time or more for 135 instructional days per school year.[8]

 

Definition of elementary teacher under NCLB:

1.                  Any teacher teaching in a self-contained classroom in grades pre-K through 8.

 

Definition of Elementary School:

1.                  Any combination of grades preK through 8.[9]

2.                  NCLB definitions state: “The term ‘elementary school’ means a nonprofit institutional day or residential school including a public elementary charter school that provides elementary education as determined under State law.”[10]

3.                  Elementary is considered to be self-contained classrooms only for grades preK-8.


Definition of undergraduate major (includes coursework equivalent to a major):

1.                  Forty-five quarter hours or 30 semester hours of undergraduate or graduate coursework in the subject.

2.                  These must be documented accredited college or university courses.

3.                  Continuing professional development workshops do not count toward this definition unless they were taken through a college or university for credit in the subject-matter area.

 

Definition of Middle-level school includes at least one of the following:

1.                  An organizational unit composed of any combination of grades 5, 6, 7 and 8 organized separately from other elementary grades and identified as a middle school with the Oregon Department of Education[11]; OR

2.                  A junior high school composed of one or more grades 7, 8 and 9 organized separately from other grades and approved by the Oregon Department of Education.[12]

3.                  Only departmentalized middle-level grades will require highly qualified middle-level subject-matter content competency for teachers.

4.                  All self-contained classrooms will only need to meet the qualifications for highly qualified elementary teachers.

5.                  With integrated curriculum courses, the teacher need only be highly qualified in either subject.

 

 

Definition of Secondary School:

1.                  Any combination of grades 10 through 12 in districts providing a junior high school containing grade 9; any combination of grades 9 through 12 organized as a separate unit; grades 9 through 12 housed with grades K through 12; grades 7 or 8 through 12, if approved by the Oregon Department of Education.[13]

2.                  NCLB definitions state: “The term ‘secondary school’ means a nonprofit institutional day or residential school, including a public secondary charter school that provides secondary education as determined under State law, except that the term does not include any education beyond grade 12.”[14]

 

Definition of Advanced Credential or Advanced Certification for Middle-Level and Secondary Teachers:

1.                  Continuing Teaching License

2.                  National Board Certification[15]

3.                  Standard Teaching License in the subject-matter area.

 

ELEMENTARY TEACHERS

 
 

 

 

 

 


Federal Definition of Highly Qualified Elementary Teacher New to the Profession:

 

An elementary teacher covered under the No Child Left Behind Act who is new to the profession must have obtained full state licensure, which may include licensure obtained through alternative routes; or has passed the state teacher licensing examination and holds a license to teach in the state; and has not had licensure requirements waived on an emergency, temporary or provisional basis. In addition, an elementary teacher who is new to the profession must also hold at least a bachelor’s degree and must demonstrate subject-matter knowledge and teaching skills by passing a rigorous state test.

 

 

 

 

Oregon Definition of Highly Qualified Elementary Teachers new to the profession:

1.                  Must hold basic, initial; OR

2.                  Must hold an Approved NCLB Alternative Route Teaching License[16] AND

3.                  Must hold Bachelor’s Degree; AND

4.                  Must have passed the Multiple Subjects Assessment Test; AND

5.                  Must be properly assigned in a preK-8 self-contained classroom.[17]

 

Applying this definition to new elementary teachers in self-contained classrooms:

1.                  Must hold basic, initial, or Approved NCLB Alternative Route Teaching License.

2.                  Must hold the appropriate authorization, such as early childhood, elementary, middle-level, and be properly assigned in those grades. (See chart on pages 17 and 18.)

2.         Must hold the appropriate authorization, such as early childhood, elementary, middle-level, and be properly assigned in those grades. (See chart on pages 17 and 18.)

 

 

High Objective Uniform State Standards of Evaluation (HOUSSE) requirements for Elementary teachers not new to the profession:

1.                  Satisfied if have completed an approved elementary teacher education program or the coursework equivalent to the following in any regionally accredited institution in the United States or an equivalent approved program in a foreign institution; and

a.                   The program or its equivalent must include sixty quarter hours designed to develop competence in elementary instruction, distributed as follows:

i.                     Eighteen quarter hours of language arts;

ii.                   Twelve quarter hours of mathematics;

iii.                  Nine quarter hours in science;

iv.                 Nine quarter hours in U.S. history, cultural geography, and other social sciences;

v.                   Three quarter hours in health education;

vi.                 Three quarter hours in physical education;

vii.                Three quarter hours in music education; and

viii.              Three quarter hours in art education; OR

2.                  Completed TSPC Alternative Assessment in lieu of MSAT or NTE Core Battery Test[20]; OR

3.                  National Board Certified as Early Childhood Generalist, Early Childhood Art, Early Childhood Music, or Early Childhood ESOL; OR

4.                  Holds a Standard Elementary License; OR

5.                  Holds a Master’s Degree.

 

 

Middle and Secondary Teachers

 
 

 

 

 

 


Federal Definition of Highly Qualified Middle Level or Secondary Teacher New to the Profession:

 

A middle or secondary school teacher covered under the No Child Left Behind Act who is new to the profession must have obtained full state licensure, which may include licensure obtained through alternative routes; or has passed the state teacher licensing examination and holds a license to teach in the state; and has not had licensure requirements waived on an emergency, temporary or provisional basis. In addition, a middle or secondary school teacher who is new to the profession must also hold at least a bachelor’s degree and either must demonstrate a high level of subject-matter competency in each of the core academic subjects in which the teacher teaches by passing a rigorous state test OR has successfully completed an undergraduate major, a graduate degree, coursework equivalent to an undergraduate major or advanced certification or credentialing.

 

Oregon Definition of Highly Qualified Middle Level (departmentalized grades 5-8) Teacher New to the Profession:

1.                  Must hold basic, initial, or teaching license; OR

2.                  Must hold Approved NCLB Alternative Route Teaching License; AND

3.                  Must hold Bachelor’s Degree; AND

4.                  Must have passed the Praxis Test in each core academic subject in which the teacher teaches; OR

5.                  Must have successfully completed in each core academic subject in which the teacher teaches either:

a.                   An undergraduate major;

b.                  A graduate degree;

c.                   Coursework equivalent to an undergraduate major; OR

d.                  Advanced certification or credentialing[21] AND

6.                  Must hold the appropriate endorsement for the subject-matter area[22]; and

7.                  Must be properly assigned.[23]

 

Applying this definition to new middle-level teachers in core academic subjects:

1.                  Must hold basic, initial, continuing, or Approved NCLB Alternative Route Teaching License. AND

2.                  Must hold middle-level endorsement in the subject.[24] (Verify middle-level endorsement eligibility with TSPC.)

 

Oregon Definition of Highly Qualified Secondary (grades 9-12) Teacher New to the Profession:

1.                  Must hold basic or initial; OR

2.                  Must hold Approved NCLB Alternative Route Teaching License AND

3.                  Must hold Bachelor’s Degree; AND

4.                  Must have passed the Praxis Test in each core academic subject in which the teacher teaches; OR

5.                  Must have successfully completed in each academic subject in which the teacher teaches either:

a.                               An undergraduate major;

b.                              A graduate degree;

c.                               Coursework equivalent to an undergraduate major; OR

d.                              Advanced certification or credentialing[25] AND

6.                  Must hold the appropriate endorsement for the subject-matter area; AND

Applying this definition to new secondary teachers in core academic subjects:

1.                  Must hold basic, standard, initial, continuing, or Approved NCLB Alternative Route Teaching License; AND

2.                  Must hold subject-matter endorsement in the subject.

Oregon Definition of Highly Qualified Middle Level Teacher Not New to the Profession:

1.                  Must hold basic, standard, initial, continuing or five-year secondary teaching license; AND

2.                  Must hold Bachelor’s Degree; AND

3.                  Must have passed the Praxis Test in each academic core subject in which the teacher teachers; OR

4.                  Must have successfully completed in each academic subject in which the teacher teaches either:

a.                   An undergraduate major;

b.                  A graduate degree;

c.                   Coursework equivalent to an undergraduate major; OR

d.                  Advanced certification or credentialing; OR

5.                  Must satisfy the HOUSSE requirements set forth below; AND

6.                  Must be properly assigned.[27]

 

Applying this definition to not new middle-level teachers in core academic subjects:

1.                  Must hold basic, initial, standard, continuing, or five-secondary license;[28] AND

2.                 Must hold subject-matter endorsement in the subject.  (Verify middle-level endorsement eligibility with TSPC.)

 

High Objective Uniform State Standard of Evaluation (HOUSSE) requirements for Middle-Level (grades 5-8) Teachers Not New to the Profession: (Applies to Middle-Level only)

1.                  Must have 3 years or more teaching in the subject matter area; AND

2.                  Must have 24 quarter credit hours or 16 semester hours in the subject matter area.

 

TSPC is developing new middle-level endorsements for teachers new and not new to the profession.

 

If the teacher is new to the profession, until middle-level tests are adopted, a major or coursework equivalent to a major will qualify the teacher for a middle-level endorsement.

 

If the teacher is not new to the profession, teaching the subject 3 years or more and having 24 hours of coursework related to the subject-matter will qualify the teacher for a middle-level endorsement.

 

Only TSPC may grant the middle-level endorsement needed to be highly qualified.

 

Oregon Definition of Highly Qualified Secondary Teacher Not New to the Profession:

1.                  Must hold basic, standard, initial, continuing or five-year secondary teaching license; AND

2.                  Must hold Bachelor’s Degree; AND

3.                  Must have passed the Praxis Test in each academic core subject in which the teacher teachers; OR

4.                  Must have successfully completed in each academic subject in which the teacher teaches either:

                                           a.            An undergraduate major;

                                          b.            A graduate degree;

                                           c.            Coursework equivalent to an undergraduate major; OR

                                          d.            Advanced certification or credentialing; AND

5.                  Must be properly assigned.[29]

 

Applying this definition to not new secondary teachers in core academic subjects:

1.         Must hold basic, standard, initial, continuing, or five-year secondary teaching license; AND

2.         Must hold subject-matter endorsement in the subject.


 

Special Education Teachers

 
 

 

 

 

 


Special Education Teachers:

1.                  Special Education teachers who are providing instruction in core academic subject also must meet the “highly qualified” standards of the law.

2.                  However, special educators who do not directly instruct students on any core academic subject, or who provide only consultation to highly qualified teachers of core academic subjects in adapting curricula, using behavioral supports and interventions, and selecting appropriate accommodations, are not subject to the same requirements that apply to teachers of core academic subjects.[30]

 

Elementary Special Education Teachers:

1.                  If hold an elementary special education endorsement or an elementary endorsement or authorization with special education, then highly qualified to teach K-8 self-contained special education classroom.

 

Middle-level/Secondary Special Education Teachers:

1.                  If teaching core academic subject, must have a partnership relationship with a highly qualified teacher in the core academic area if not highly qualified in the subject matter area.

Federal Definition from No Child Left Behind Act:

(23) HIGHLY QUALIFIED- The term highly qualified’ —

(A) when used with respect to any public elementary school or secondary school teacher teaching in a State, means that —

(i)   the teacher has obtained full State certification as a teacher (including certification obtained through alternative routes to certification) or passed the State teacher licensing examination, and holds a license to teach in such State, except that when used with respect to any teacher teaching in a public charter school, the term means that the teacher meets the requirements set forth in the State’s public charter school law; and

(ii)  the teacher has not had certification or licensure requirements waived on an emergency, temporary, or provisional basis;

(B) when used with respect to —

(i)   an elementary school teacher who is new to the profession, means that the teacher —

(I)     holds at least a bachelor’s degree; and

(II)    has demonstrated, by passing a rigorous State test, subject knowledge and teaching skills in reading, writing, mathematics, and other areas of the basic elementary school curriculum (which may consist of passing a State-required certification or licensing test or tests in reading, writing, mathematics, and other areas of the basic elementary school curriculum); or

(ii)  a middle or secondary school teacher who is new to the profession, means that the teacher holds at least a bachelor’s degree and has demonstrated a high level of competency in each of the academic subjects in which the teacher teaches by —

(I)     passing a rigorous State academic subject test in each of the academic subjects in which the teacher teaches (which may consist of a passing level of performance on a State-required certification or licensing test or tests in each of the academic subjects in which the teacher teaches); or

(II)    successful completion, in each of the academic subjects in which the teacher teaches, of an academic major, a graduate degree, coursework equivalent to an undergraduate academic major, or advanced certification or credentialing; and

(C) when used with respect to an elementary, middle, or secondary school teacher who is not new to the profession, means that the teacher holds at least a bachelor’s degree and

(i)   has met the applicable standard in clause (i) or (ii) of subparagraph (B), which includes an option for a test; or

(ii)  demonstrates competence in all the academic subjects in which the teacher teaches based on a high objective uniform State standard of evaluation that —

(I)     is set by the State for both grade appropriate academic subject matter knowledge and teaching skills;

(II)    is aligned with challenging State academic content and student academic achievement standards and developed in consultation with core content specialists, teachers, principals, and school administrators;

(III)   provides objective, coherent information about the teacher’s attainment of core content knowledge in the academic subjects in which a teacher teaches;

(IV)   is applied uniformly to all teachers in the same academic subject and the same grade level throughout the State;

(V)    takes into consideration, but not be based primarily on, the time the teacher has been teaching in the academic subject;

(VI)   is made available to the public upon request; and

(VII) may involve multiple, objective measures of teacher competency.

 


§200.56  Definition of “highly qualified teacher.”

 

            To be a “highly qualified teacher,” a teacher covered under §200.55 must meet the requirements in paragraph (a) and either paragraph (b) or (c) of this section.

           

(a)    In general.

 

(1)  Except as provided in paragraph (a)(3) of this section, a teacher covered under §200.55 must--

(i)   Have obtained full State certification as a teacher, which may include certification obtained through alternative routes to certification; or

(ii)        (A)    Have passed the State teacher licensing examination; and

(B)        Hold a license to teach in the State.

 

(2)  A teacher meets the requirement in paragraph (a)(1) of this section if the teacher--

(i)   Has fulfilled the State’s certification and licensure requirements applicable to the years of experience the teacher possesses; or

            (ii)  Is participating in an alternative route to certification program under which—-

(A)    The teacher--

(1)  Receives high-quality professional development that is sustained, intensive, and classroom-focused in order to have a positive and lasting impact on classroom instruction, before and while teaching;

(2)  Participates in a program of intensive supervision that consists of structured guidance and regular ongoing support for teachers or a teacher mentoring program; 

(3)  Assumes functions as a teacher only for a specified period of time not to exceed three years; and

(4)  Demonstrates satisfactory progress toward full certification as prescribed by the State; and

(B)        The State ensures, through its certification and licensure process, that the provisions in paragraph (a)(2)(ii) of this section are met.

 

(3)  A teacher teaching in a public charter school in a State must meet the certification and licensure requirements, if any, contained in the State’s charter school law.

 

(4)  If a teacher has had certification or licensure requirements waived on an emergency, temporary, or provisional basis, the teacher is not highly qualified.

 


 

(b)  Teachers new to the profession.  A teacher covered under §200.55 who is new to the profession also must  

 

(1)  Hold at least a bachelor’s degree; and

(2)  At the public elementary school level, demonstrate, by passing a rigorous State test (which may consist of passing a State certification or licensing test), subject knowledge and teaching skills in reading/language arts, writing, mathematics, and other areas of the basic elementary school curriculum; or

(3)  At the public middle and high school levels, demonstrate a high level of competency by--

(i)   Passing a rigorous State test in each academic subject in which the teacher teaches (which may consist of passing a State certification or licensing test in each of these subjects); or

(ii)  Successfully completing in each academic subject in which the teacher teaches--

(A)    An undergraduate major;

(B)    A graduate degree;

(C)    Coursework equivalent to an undergraduate major; or

(C)        Advanced certification or credentialing.

 

 

(c)  Teachers not new to the profession.  A teacher covered under §200.55 who is not new to the profession also must--

 

(1)  Hold at least a bachelor’s degree; and

(2)  (i)   Meet the applicable requirements in paragraph (b)(2) or (3) of this section;  or

(ii)  Based on a high, objective, uniform State standard of evaluation in accordance with section 9101(23)(C)(ii) of the ESEA, demonstrate competency in each academic subject in which the teacher teaches.

[17] Initial and Continuing Licensed Elementary Teachers are still required to be properly assigned according to their grade authorization level and with regard to the specialty area endorsement requirements for: art, bilingual education with English for speakers of other languages (ESOL), ESOL alone, music, physical education, adaptive physical education, reading and special education.
